Report proposes reversal of litigation funding

Civil Justice Council tells ministers to undo effects of Supreme Court ruling after fears cases would be thrown into chaos

A two-year-old Supreme Court ruling that sparked panic among litigation funders must be “reversed as soon as possible”, a body advising the lord chancellor has told ministers.

“Reversing Paccar will finally put an end to the uncertainty that has hampered funders’ willingness to invest in important and meritorious cases,” David Greene, the co-head of the Collective Redress Lawyers Association, said. He urged ministers “to take up the recommendation immediately”, adding that the council’s “proposed light-touch regulation of funders is a much preferred route in this very young market”
