Co-president Martyn Day comments as the Litigation Funding Agreements (Enforceability) Bill will not progress before Parliament ahead of General Election
Martyn Day, co-president of CORLA (the Collective Redress Lawyers Association) commented: “The decision by the government to drop the bill is disappointing news. A lot of time has been spent pressing for the bill, to provide certainty following the PACCAR judgment by the Supreme Court. This certainty would have meant that funders, in particular, would have been able to support more cases sure in the knowledge that they would not find some technical challenge to their funding arrangement.
“That certainty is now lost for at least some months while the political future of the country is decided. Whether the new government will prioritise this issue is very much open to debate.”
